Nevertheless, in order to make possible a rapid execution of the sale, a coupon will be established for each purchaser. These coupons are payable at the end of each day’s sale. The buyer of any lot shall provide bank references or pay the full purchase price, or a fractional deposit as may be determined at the discretion of the auctioner. Article 2: The adjudication is awarded to the person who made the highest offer. Any litigation cancels the adjudication and the lot will immediately put again up of for sale. Article 3: The legal bailiff or the auctioneer has absolute discretion to advance the bidding, to divide, to combine or to withdraw one or more lots from the sale. In case wherein a reserve price has been fixed, the legal bailiff reserves to himself the right to bid for the account of the vendor. If the reserve price fixed by the vendor is not attained, he shall pass on the auctioning of the next lot, by a single tap with his hammer. Article 4: The purchaser pays a supplementary tax of 18 % above the adjudicated price of each lot. The purchasers have to pay an additional tax of 17, 5 % VAT (value added tax). Purchasers domiciled abroad who submit declarations of the export of the purchased objects, stamped by the United Kingdom Customs, will receive reimbursement of 17,5 % VAT of the value of the purchases. Article 5: For any delay in payment of the total amount of the purchase prices, the auction house will charge an interest of 3% per month. Article 6: All the information and descriptions appearing in the catalogue are given with full knowledge and conscience. No claims will be accepted after the sale. Article 7: Every purchaser is responsible for the purchase effected in his name. He cannot contend that he had acted for the account of a third party. Article 8: The prices indicated in the catalogue constitute the starting prices in British pounds. It can happen that the prices obtained may be much higher than this prices. Article 9: Higher bids must be spoken aloud or made by signs expressing unequivocally the wishes of the bidder. The legal bailiff reserves to himself the right to refuse offers coming from unknown purchasers. Article 10: The amount of the bid increases is usually fixed at 10 %. However, the legal bailiff may modify those percentages subject to prior announcement. Article 11: The purchase orders will be executed by the legal bailiff with care and no additional cost. They must be confirmed in writing. Article 12: The profits and the risks pass to the purchaser immediately upon the adjudication. The transfer to the purchaser of the ownership of the merchandise will, however, not be effected until the purchase price has been paid in full. A 4% surcharge will be applied to credit card payments. Article 13: In the event of any contradiction between the several translations of the conditions of sale, the English text alone shall be applied. Article 14: Any litigation arising out of the interpretation or execution of the present condition of sale shall be submitted by United Kingdom law and jurisdictions, under reservation of recourse to the United Kingdom Tribunal, whatever is the domicile of the purchasers. CONDITIONS DE VENTE La participation aux enchères implique l'acceptation inconditionnelle des présentes conditions de vente: Art. 1. - La vente a lieu strictement au comptant, en livres sterling. Toutefois, pour permettre un déroulement rapide de celle-ci, il sera établi un bordereau pour chaque acheteur qui doit donner son identité lors de l'adjudication. Les bordereaux sont payables à la fin de chaque vacation. L'huissier se resérve le droit de demander des références bancaires et un dépôt, proportionel du montant enchéri. Art. 2. - L'adjudication sera prononcée en faveur du dernier enchérisseur. En cas de litige l'adjudication sera annulée et le lot est immédiatement remis en vente. Art. 3. - L'huissier judiciaire ou crieurs ont le droit d'avancer les enchères, de séparer, joindre ou retirer n'importe quel lot, cela à leur absolue discrétion. Dans le cas où un prix de réserve a été fixé, l'huissier judiciaire se réserve le droit d'enchérir pour le compte du vendeur. Lorsque le prix de réserve fixé par le vendeur n'est pas atteint, il sera passé à la criée du lot suivant par un simple coup de marteau. Art. 4. - L'acheteur paie une surtaxe de 18% en sus du prix d'adjudication de chaque lot, plus TVA 17,5% . Pour les acheteurs étrangers, la TVA 17,5% leur sera remboursée sur présentation d'une déclaration d'exportation. Art. 5. - La maison de vente perçoit un intérêt moratoire de 3% par mois pour tous les achats qui n'ont pas été payés 30 jours après la date de la vente. Art. 6. - Toutes les indications et descriptions dans ce catalogue sont données en toute science et conscience. Aucune reclamation ne sera acceptée après la vente. Art. 7. - L'acheteur est personnellement responsable de tout achat effectué en son nom. Il ne peut pas prétendre avoir agi pour le compte d'un tiers. Art. 8. -Les prix indiqués au catalogue constituent des prix de départ de l'enchère en livres sterling. Il se peut que les prix obtenus soient beaucoup plus élevés que ces prix. Art. 9. - Les surenchères doivent avoir lieu à haute voix, ou par signes traduisant sans équivoque la volonté de surenchérir. L'huissier judiciaire se réserve le droit de refuser les enchères émanant d'acheteurs inconnus. Art. 10. - Le montant minimum des surenchères est fixé à 10%. Toutefois, l'huissier judiciaire pourra modifier ce taux en l'annonçant préalablement. Art. 11. - Les ordres d'achats seront exécutés avec soin et sans frais par l'huissier judiciaire et devront être confirmés par écrit. Art. 12. - Les profits et risques passent à l'acheteur dès l'adjudication prononcée; il ne devient toutefois propriétaire de l'objet qu'une fois le paiement complet effectué. En cas de paiement par carte de crédit, une commission de 4% est perçue. Art. 13. - En cas de divergence, la version anglaise des conditions de vente fait foi. Art. 14. - Tout litige relatif à la vente est soumis à l'application exclusive du droit anglais et à la juridiction des tribunaux anglais, cela quel que soit le domicile des parties, sous réserve de recours au Tribunal anglais.
