Nevertheless, in order to make possible arapid execution of the sale, a coupon will be established for eachpurchaser. These coupons are payable at the end of each day’s sale. Article 2: The adjudication isawarded to the person who made the highest offer. Any litigation cancels theadjudication and the lot will immediately put again up of for sale. Article 3: The huissier judiciaire or the auctioneer has absolute discretion to advance the bidding, todivide, to combine or to withdraw one or more lots from the sale. Incase wherein a reserve price has been fixed, the huissier judiciaire reservesto himself the right to bid for the account of the vendor. If the reserveprice fixed by the vendor is not attained, he shall pass on the auctioning ofthe next lot, by a single tap with his hammer. Article 4: The purchaserpays a supplementary tax of 15% above the adjudicated price of each lot. Buyersof medals and silver or bronze coins have to pay an additional taxof 7,6% VAT (value added tax). Purchasers domiciled abroad who submitdeclarations of the export of the purchased objects, stamped by theSwiss Customs, will receive reimbursement of 7,6% VAT of the value of thepurchases. Article 5: For any delayin payment of the total amount of the purchase prices, the auction house willcharge an interest of 1% per month. Article 6: All the information anddescriptions appearing in the catalogue are given with full knowledge andconscience. Consequently, the authenticity of the objects isguaranteed, if not mentionned as «collectors copy». Article 7: Every purchaser isresponsible for the purchase effected in his name. He cannot contend that hehad acted for the account of a third party. Article 8: The prices indicated inthe catalogue constitute the starting prices. It can happen that pricesobtained may be much higher than the estimates. Article 9: Higher bids must bespoken aloud or made by signs expressing unequivocally the wishes of thebidder. The huissier judiciaire reserves to himself the right to refuseoffers coming from unknown purchasers. Article 10: The amount of the bidincreases is usually fixed at 10%. However, the huissier judiciaire may modifythose percentages subject to prior announcement. Article 11: The purchase orders willbe executed by the huissier judiciaire with care and no additional cost. Theymust be confirmed in writing. Article 12: The profits and the riskspass to the purchaser immediately upon the adjudication. The transfer to thepurchaser of the ownership of the merchandise will, however, not beeffected until the purchase price has been paid in full. Article 13: In the eventof any contradiction between the several translations of the conditions ofsale, the French text alone shall prevail. Article 14: Anylitigation arising out of the interpretation or execution of the presentcondition of sale shall be submitted by Swiss law and jurisdictions of the Canton of Vaud,under reservation of recourse to the Swiss federal Tribunal, whatever is thedomicile of the purchasers. CONDITIONS DE VENTE La participation auxenchères implique l’acceptation inconditionnelle des présentesconditions de vente: Art. 1. – La vente a lieustrictement au comptant, en francs suisses. Toutefois, pour permettre un déroulementrapide de celle-ci, il sera établi un bordereau pour chaque acheteur quidoit donner son identité lors de l’adjudication. En cas de litige l’adjudicationsera annulée et le lot est immédiatement remis en vente. Art. 3. – L’huissierjudiciaire ou crieurs ont le droit d’avancer les enchères, de séparer,joindre ou retirer n’importe quel lot, cela à leur absolue discrétion. Dans le cas où unprix de réserve a été fixé, l’ huissier judiciaire se réserve le droitd’enchérir pour le compte du vendeur. Lorsque le prix de réserve fixé par levendeur n’est pas atteint, il sera passé à la criée du lot suivant parun simple coup de marteau. Art. 4. – L’acheteur paieune surtaxe de 15% en sus du prix d’adjudication de chaque lot; plus TVA 7,6%pour les médailles et les monnaies en argent et en bronze. Art. 9. – Les surenchèresdoivent avoir lieu à haute voix, ou par signes traduisant sans équivoquela volonté de surenchérir.
